If the Smichas that the early Achronim received when the Rabbonim of Eretz Yisroel got together would still be around, would they be able to give Malkus and kill people like a Besi Din provided they had 23 of them?

The ability to try criminal cases would require autonomous rule. The ability to try capital cases would need to be reestablished by the Great Sanhedrin of 71.
